Terms

Terms & Conditions

The terms a rental runs on - what we do, what the site owner does, and what happens when something changes mid-job.

1. Agreeing to these terms

These terms apply to rentals arranged with Chula Vista Porta Potty and to the use of https://www.chulavistaportapotty.com. Booking a rental over the telephone means agreeing to them. Nothing on this website is an offer capable of acceptance - prices are quoted on a call, for a specific job, and a rental exists once we have confirmed it with you.

2. What is being rented

Portable restroom units, ADA accessible restroom units, portable hand washing stations and restroom trailers, together with delivery, the servicing agreed at booking, and collection. The units remain our property throughout. You are renting their use for the agreed period, not buying them.

3. Quotes and prices

A quote given on the telephone covers delivery, the units listed, the agreed service visits, collection and tax, and it holds for the job as described to us. If the job changes - more units, a longer period, a different site, a higher service frequency - we will quote the change openly before carrying it out.

Costs we could not have foreseen, such as a wasted journey because a site was locked or inaccessible, may be charged separately. We will tell you when that has happened rather than adding a line quietly.

4. Payment

Payment terms are agreed when the rental is booked. Invoices are due on the terms stated on them. Cards are processed by our payment provider; we do not hold card numbers. We may suspend servicing or collect units where an account is significantly overdue, after telling you first.

5. Your site, and access to it

You are responsible for telling us the truth about the site: where the unit should go, what the ground is like, how close a vehicle can get, and any gate, code or permission needed. You confirm that you have the right to place a unit where you have asked us to put it.

Access must remain available for the agreed service visits and for collection. If a unit cannot be reached on a scheduled visit, we will attempt it again and may charge for the wasted journey.

6. Placement and safety

Units are placed on firm, reasonably level ground and, where conditions require it, staked or strapped. Units must not be moved by you or by anyone else on site after delivery - a relocated unit may not be level, may not be reachable by the service vehicle, and becomes your risk. If a unit needs to move, call us and we will schedule it.

7. How the units may be used

Units are for ordinary human sanitary use. They must not receive chemicals, paint, solvents, construction waste, cooking oil, animal waste or anything else that is not normal sanitary waste. Nothing may be attached to, painted on or fixed to a unit. Where a unit is damaged, lost or contaminated beyond normal use, the cost of repair, cleaning or replacement is yours.

8. Servicing

We service units at the frequency agreed when you book. Where use is heavier than described, we will tell you and propose a higher frequency rather than allowing a unit to become unusable. We schedule around what is happening on site where we reasonably can, but service timings are estimates and not guarantees.

9. Delivery and collection windows

Delivery and collection times are given in good faith and are usually met, but traffic, weather, site access and events outside our control can move them. Where a delivery is going to be late, we will tell you. We are not liable for indirect losses caused by a delayed delivery or collection.

10. Permits and permissions

Where a unit is to be placed in a public right of way, on public land, or anywhere that a permit or consent is required, obtaining that permit is your responsibility. We will place to whatever conditions a permit sets - including a specified number of accessible units - if you tell us what those conditions are.

11. Canceling or changing a rental

Tell us as early as you can. A rental canceled before the unit is loaded normally costs nothing. Once a vehicle has been dispatched, a charge may apply for the journey. Extensions and additions are arranged by telephone and are subject to availability.

12. Liability

We are responsible for delivering, servicing and collecting the units with reasonable care and skill. We are not responsible for injury or damage arising from misuse of a unit, from a unit being moved by someone else, from ground conditions we were not told about, or from circumstances outside our reasonable control. Nothing in these terms limits liability that cannot be limited by law. Where liability can be limited, it is limited to the amount paid for the rental in question.

13. This website

The content of this site is provided for general information. Sizing guidance and the calculator on the rental desk pages are estimates to help you plan, not a professional assessment and not a quote. The text, images and layout of this site belong to us and may not be copied or republished without permission.

14. Governing law

These terms are governed by the law of the State of California. Any dispute arising out of them is subject to the exclusive jurisdiction of the state and federal courts sitting in San Diego County, California.
